Wal-Mart, Sean Combs clothing at Bangladesh factory

10 hrs.

Amid the ash, broken glass and melted sewing machines at what is left of the Tazreen Fashions Ltd. factory, there are piles of blue, red and off-white children's shorts bearing Wal-Mart's Faded Glory brand. Shorts from hip-hop star Sean Combs' ENYCE label lay on the floor and are stacked in cartons.

An Associated Press reporter searching the factory Wednesday found these and other clothes, including sweaters from the French company Teddy Smith, among the equipment charred in the fire that killed 112 workers Saturday. He also found entries in account books indicating that the factory took orders to produce clothes for Disney, Sears and other Western brands.

Garments and documents left behind in the factory show it was used by a host of major American and European retailers, though at least one of them ? Wal-Mart ? had been aware of safety problems. Wal-Mart blames a supplier for using Tazreen Fashions without its knowledge.

The fire has elevated awareness of something labor groups, retailers and governments have known for years: Bangladesh's fast-growing garment industry ? second only to China's in exports ? is rife with dangerous workplaces. More than 300 workers there have died in fires since 2006.

Police on Wednesday arrested three factory officials suspected of locking in the workers who died in Saturday's fire, the deadliest in the South Asian country's less than 35-year history of exporting clothing.

Local police chief Habibur Rahman said the three will be questioned amid reports that many workers trying to escape the blaze had been locked inside. He said the owner of the factory was not among those arrested.

The three officials were arrested Wednesday at their homes in Savar, the Dhaka suburb where the factory is also located. Rahman did not identify the officials or give their job status.

About 1,400 workers worked at the plant, some 70 percent of them women. Most are from the north, the poorest region of Bangladesh.

Workers who survived the fire say exit doors were locked, and a fire official has said that far fewer people would have died if there had been even one emergency exit. Of the dead, 53 bodies were burned so badly they could not be identified; they were buried anonymously.

The fire started on the ground floor, where a factory worker named Nasima said stacks of yarn and clothes blocked part of the stairway.

Nasima, who uses only one name, and other workers said that when they tried to flee, managers told them to go back to their work stations, but they were ignored.

Dense smoke filled the stairway, making it hard to see, and when the lights went out the workers were left in total darkness. Another worker, Mohammad Rajib, said some people used their cellphones to light their way.

"Everyone was screaming for help," Nasima said. "Total chaos, panic and screaming. Everyone was trying to escape and come out. I was pulling the shirt of a man. I fainted and when I woke up I found myself lying on the road outside the factory.

"I don't know how I survived."

Rajib said the factory conducted a fire drill just three days before the fire broke out, but no one used the fire extinguishers. "Only a selected group of workers are trained to use the extinguishers. Others have no idea how to use them," he said.

The AP reporter who examined the factory Wednesday saw dozens of fire extinguishers with tags indicating they were inspected early this month. Many appeared unused.

Workers expressed support for the factory owner, Delwar Hossain. Rajib said he is "a gentle man" who heeded workers when they protested for more pay and against rough behavior by some managers.

"He took action and fired some of them," he said. "He did not sack any worker. He told us: 'You are my people. If you survive, I will survive.'"

Most the fire's devastation took place on the second and third floors. Sewing and embroidery machines and tables burned to ashes, ceiling fans melted and floor and wall tiles were broken, apparently because of excessive heat. Thick black ash covers everything in the upper floors of the eight-story building.

Much of the clothing on the lower floors was incinerated. Nightgowns, children's shorts, pants, jackets and sweat shirts were strewn about, piled up in some places, boxed in others. Cartons of kids' hooded sweaters, off-white with red and black print, were marked "Disney Pixar."

There were also at least four register books listing buyers including Wal-Mart, Disney, Sears and other companies. Also listed was Li & Fung, a Hong Kong-based buying house that is among the biggest suppliers of garment products from Bangladesh. Li & Fung issued a statement Monday saying it placed orders at the factory for just one company, Kids Headquarters, and that the value of those orders totaled just $111,000.

Prime Minister Sheikh Hasina and Interior Minister Muhiuddin Khan Alamgir have said arson is suspected. Police say they have not ruled out sabotage.

Wal-Mart had received an audit deeming the factory "high risk" last year, said it had decided to stop doing business with Tazreen, but that a supplier subcontracted work to the factory anyway. Wal-Mart said it stopped working with that supplier on Monday.

Calls made to The Walt Disney Company and to Sears Holdings were not immediately returned.

Local TV reports said about 3,000 garment workers held protests over the fire Wednesday, blocking roads and throwing stones at some factories and vehicles. It was the third straight day of demonstrations, and as they did previously, factories in the area closed to avoid violence.

Police used batons to disperse the protesters, but no injuries were immediately reported.

According to local television, most factories in the area closed after opening briefly because of the protests ? a common tactic to avoid violence.?

Associated Press writer Farid Hossain in Dhaka, Bangladesh, contributed to this report.?

Senate gives green light to Pentagon green energy

WASHINGTON (AP) ? The Senate on Wednesday gave the green light to the Pentagon's investment in green energy.

By a vote of 62-37 on Wednesday, the Senate backed an amendment that would delete a provision in the defense bill prohibiting the military from spending money on alternative fuels if the cost exceeded traditional fossil fuels such as coal, natural gas and oil. The Pentagon has opposed the provision that a sharply divided Senate Armed Services Committee added in May.

The Navy and Air Force have pushed to use more biofuels to operate its aircraft and ships, with military leaders suggesting a greater reliance on alternative sources in the next decade to ease dependence on foreign oil.

"It should tell us something that in an era of reduced Defense Department budgets, our senior leaders remain fully committed to this effort. We should support them in these commonsense approaches," said Sen. Mark Udall, D-Colo., sponsor of the amendment.

The strong bipartisan vote reflected the growing business of alternative fuels in states such as Iowa and Kansas as well as the Dakotas as 11 Republicans joined 49 Democrats in backing the measure. Two Democrats from coal-producing states ? Joe Manchin of West Virginia and Jim Webb of Virginia ? voted against the amendment.

The Senate finally began work Wednesday on the far-reaching, $631 billion defense policy bill for next year ? six months after the Armed Services Committee acted on the legislation and the House passed its version. The bill authorizes money for weapons, ships, aircraft and a 1.7 percent pay raise for military personnel.

The total is $4 billion less than the House-passed bill, and House-Senate negotiators will have to work out the difference in the closing days of the year.

During the debate, Udall pointed out that the Defense Department consumes approximately 330,000 barrels of oil a day and this year, the military has already spent $15 billion on fuel. Based on increased oil prices, the amount is $2.5 billion more than the department had planned and another month remains.

To deal with the rising costs and reliance on foreign oil, the department is exploring alternative fuels.

The Pentagon is pushing for $1.4 billion in next year's budget for investments in clean energy, including hybrid electric drives for ships, more efficient engines, better generators and solar power.

"As one of the largest landowners and energy consumers in the world, our drive is to be more efficient and environmentally sustainable," Defense Secretary Leon Panetta said in a speech in May to the Environmental Defense Fund. "We have to be able to have the potential to transform the nation's approach to the challenges we are facing in the environment and energy security. We've got to look ahead to try to see how we can best achieve that."

Republican Sens. John McCain of Arizona and Jim Inhofe of Oklahoma have pushed to limit Pentagon investments in clean energy, arguing that in a time of defense budget cuts the Pentagon can't afford spending money on green energy projects.

Inhofe has gone further, saying earlier this year that Panetta has a "real war to win, and he should not be wasting time perpetrating President Obama's global warming fantasies or his ongoing war on affordable energy."

The Senate bill extends, for one year, the divisive provisions on the handling of suspected terrorists that snagged the legislation last year. The legislation would deny terror suspects, including U.S. citizens seized within the nation's borders, the right to trial and subject them to indefinite detention. It also would require military custody for foreign terrorist suspects linked to al-Qaida or its affiliates and involved in plotting against or attacking the United States.

Sen. Dianne Feinstein, D-Calif., with the support of conservative Sens. Rand Paul, R-Ky., and Mike Lee, R-Utah, introduced an amendment to the bill that stipulates the government cannot detain a U.S. citizen or legal resident indefinitely without charge or trial even in with the authorization to use military force or declaration of war.

"If we give up our rights, have we not let the terrorists win?" Paul said in arguing for the amendment, which may be voted on later this week.

Amid Hurricane Sandy, a Race to Get a Liver Transplant

It was the best possible news, at the worst possible time.

The phone call from the hospital brought the message that Dolores and Vin Dreeland had long hoped for, ever since their daughter Natalia, 4, had been put on the waiting list for a liver transplant. The time had come.

They bundled her into the car for the 50-mile trip from their home in Long Valley, N.J., to NewYork-Presbyterian Morgan Stanley Children?s Hospital in Manhattan. But it soon seemed that this chance to save Natalia?s life might be just out of reach.

The date was Sunday, Oct. 28, and Hurricane Sandy, the worst storm to hit the East Coast in decades, was bearing down on New York. Airports and bridges would soon close, but the donated organ was in Nevada, five hours away. The time window in which a plane carrying the liver would be able to land in the region was rapidly closing.

In a hospital room, Natalia watched cartoons. Her parents watched the clock, and the weather. ?Our anxiety was through the roof,? Mrs. Dreeland said. ?It just made your stomach into knots.?

The Dreelands, who are in their 60s, became Natalia?s foster parents in 2008 when she was 7 months old, and adopted her just before she turned 2. They have another adopted daughter, Dorothy Jane, who is 17.

Natalia is a ?smart little cookie? who loves school and dressing up Alice, her favorite doll, her mother said. At age 3, Natalia used the word ?discombobulated? correctly, Mr. Dreeland said.

Natalia?s health problems date back several years. Her gallbladder was taken out in 2010, and about half her liver was removed in 2011. The underlying problem was a rare disease, Langerhans cell histiocytosis. It causes a tremendous overgrowth of a type of cell in the immune system and can damage organs. Drugs can sometimes keep it in check, but they did not work for Natalia.

In her case, the disease struck the bile ducts, which led to progressive liver damage. ?She would have eventually gone into liver failure,? said Dr. Nadia Ovchinsky, a pediatric liver transplant specialist at NewYork-Presbyterian. ?And she demonstrated some signs of early liver failure.?

The only hope was a transplant.

Dr. Tomoaki Kato, Natalia?s surgeon, knew that the liver in Nevada was a perfect match for Natalia in the two criteria that matter most: blood type and size. The deceased donor was 2 years old, and though Natalia is nearly 5, she is small for her age. Scar tissue from her previous operations would have made it very difficult to fit a larger organ into her abdomen.

Though Dr. Kato had considered transplanting part of an adult liver into Natalia, a complete organ from a child would be far better for her. But healthy organs from small children do not often become available, Dr. Kato said. This was a rare opportunity, and he was determined to seize it.

But as the day wore on, the odds for Natalia grew slimmer. The operation in Nevada to remove the liver was delayed several times.

At many hospitals, surgery to remove donor organs is done at the end of the day, after all regularly scheduled operations. The Nevada hospital had a busy surgical schedule that day, made worse by a trauma case that took priority.

At the hospital in New York, Tod Brown, an organ procurement coordinator, had alerted a charter air carrier that a flight from Nevada might be needed. That company in turn contacted West Coast carriers to pick up the donated liver and fly it to New York.

Initially, two carriers agreed, but then backed out. Several other charter companies also declined.

Mr. Brown told Dr. Kato that they might have to decline the organ. Dr. Kato, soft-spoken but relentless, said, ?Find somebody who can fly.?

Dr. Kato used to work in Miami, where pilots found ways to bypass hurricanes to deliver organs. Even during Hurricane Katrina, his hospital performed transplants.

?I asked the transplant coordinators to just keep pushing,? he said.

Mr. Brown said, ?Dr. Kato knew he was going to get that organ, one way or another.?

As the trajectory of the storm became clearer, one of the West Coast charter companies agreed to attempt the flight. The plan was to land at the airport in Teterboro, N.J. The backup was Newark airport, and the second backup was Albany, from where an ambulance would finish the trip.

The timing was critical: organs deteriorate outside the body, and ideally a liver should be transplanted within 12 hours of being removed.

Early Monday, as the storm whirled offshore, the plane landed at Teterboro. Soon a nurse rushed to tell the Dreelands that she had just seen an ambulance with lights and sirens screech up to the hospital. Someone had jumped out carrying a container.

At about 5 a.m., the couple kissed Natalia and saw her wheeled off to the operating room.

Three weeks later, she is back home, on the mend. The complicated regimen of drugs that transplant patients need is tough on a child, but she is getting through it, her father said.

Recently, Mr. Dreeland said, he found himself weeping uncontrollably during a church service for the family of the child who had died. ?Their child gave my child life,? he said.

Though only time will tell, because the histiocytosis appeared limited to Natalia?s bile ducts and had not affected other organs, her doctors say there is a good chance that the transplant has cured her.

New collaboration to fight breast cancer - News and Events ...

Professor Patrick Brennan: "By bringing our leading minds together, we hope to take our research in new directions to transform breast cancer treatment ."

Physiotherapists, oncologists, psychologists, physiologists and experts in breast surgery and public health have joined forces in a new multidisciplinary research group dedicated to improving the future outcomes and overall quality of life of breast cancer sufferers.

The Breast Cancer Special Interest Group (BCSIG), based in the Faculty of Health Sciences and including researchers from Sydney Medical School and the Sydney School of Public Health, hopes to improve breast cancer diagnosis and treatment by identifying, preventing and modifying the risks of breast cancer and its resulting conditions.

"The Breast Cancer Special Interest Group is one of only a handful of multidisciplinary breast cancer research centres in Australia," says Professor Patrick Brennan, a world authority on breast cancer imaging and detection and chair of the BCSIG steering committee.

"The University of Sydney is home to some of the world's leading breast cancer researchers. By bringing our leading minds together, we hope to take our research in new directions to transform breast cancer treatment from the cellular level of diagnosis all the way to treatment, the psychological state of the patient, and associated conditions like lymphoedema."

The BCSIG held its inaugural seminar on 21 November where it shared key research findings on breast cancer biology and genetics, treatment and rehabilitation, imaging and detection, and epidemiology and public health.

"Breast cancer is the most common cause of cancer-related death in Australian women, and one in 11 women will be diagnosed with breast cancer before they reach 75. It's essential that we think outside the box to prevent, diagnose and manage this disease, and bringing researchers together to share ideas and work across disciplines is one of the best ways to do this," Professor Brennan says.

The researchers within BCSIG have been successful in attracting competitive research funding, publishing in leading journals and collaborating with world-leading institutions.

Professor Brennan and colleagues in the Breastscreen Reader Assessment Strategy (BREAST), which focuses on improving the accuracy of mammogram image assessment, have attracted $1 million from the National Breast Cancer Foundation this year alone.

BCSIG steering committee member Professor Sharon Kilbreath, who also presented at the seminar, is making considerable strides towards identifying and alleviating the painful, long-term musculoskeletal problems suffered by many breast cancer survivors, including shoulder and arm problems such as lymphoedema, shoulder stiffness, weakness, pain and numbness.

Associate Professor Nehmat Houssami, also on the steering committee, has recently completed a study providing the first available Australian information about the risk of cancer recurrence drawn from the general breast cancer population, while seminar presenter Dr Justine Graham is undertaking transformative research on the link between progesterone and increased breast cancer risk at the cellular level.

Time to Pay Up and Outsource Payroll Needs? | Business 2 ...

It should not come as a big surprise that small business owners have much to do on a daily basis.

With that being the case, removing the responsibility of monthly payroll duties can save an owner both time and money over the long haul.

The big question oftentimes is not only can I handle payroll, but also health benefits, retirement plans, workers comp and more in-house? If not, should I trust someone else and outsource it?

For small business owners, their payroll responsibilities can include providing paychecks, filing quarterly reports, withholding employee taxes, issuing W-2?s at year?s end, overseeing state disability and unemployment needs, and paying withholdings to various government agencies.

If you are thinking about outsourcing your payroll processing needs, consider the following:

* What to look for ? Look at a number of payroll provider services so you have a good number of choices. Make sure they are experienced, offer stellar customer service (meaning they are available on your schedule and not the other way around), do not hit you with a pile of add-on charges, and maintain a high level of security when handling sensitive employee financial information;

* ?Tax payment service ? You want a payroll provider who is up to speed on tax laws, especially given the fact that they would need to handle a number of tax issues for you, including federal, state and sometimes local. Finding a provider offering an automatic, electronic tax payment vehicle is best. By doing so, the service determines, deposits, and files your payroll taxes;

* Direct Deposit ? Not only do many workers prefer direct deposit, meaning they do not have to go to their bank with a check, but using this form of payment can save your small business money over time. You?re not only freed up from the excessive paper that checks involve, but you also stand less chance of making human errors on the checks. Direct deposit also allows the person handling your human resources duties to not have to deal with payroll issues concerning checks and more;

* 401(k) options ? As more and more employees express concerns over their future retirement needs, it is important if you outsource to a payroll provider that they get all the issues involving retirement. Look for a provider that handles retirement plan needs, along with employee benefits. Such items here would include group health insurance, 401 (k) options, workers comp, and flexible spending accounts. With health insurance a major topic in many companies these days, it is not uncommon for job applicants to look around for employers that best meet such needs. As a result, having your benefits properly maintained can give you a leg up on the competition when it comes to hiring the best of the best;

* Monitor the numbers ? Should you choose to outsource your payroll and benefit needs, by all means do not wash your hands of them. Especially when first working with a payroll provider, make sure you oversee what they are doing, making sure everything is being done properly and efficiently. As the employer, you bear the ultimate responsibility (see below) that all employees receive their payments, taxes are properly withheld, and health insurance and retirement plans are available when necessary;

* Know the cost of mistakes ? Last but not least, one of the main reasons you need to maintain watch and control over your payroll needs even when outsourced is the potential for mistakes, especially when it comes to taxes. In the event the company you hired to do your payroll is not doing it properly, you stand to suffer the financial consequences from the IRS. As part of the Employment Tax Research Project (ETRP) unveiled two years ago, the IRS looks at the payroll practice of thousands of employers, focused specifically on worker miss-classification, fringe benefits, compensation for executives and payroll taxes. With the IRS expanding its audit scope, just a few mistakes could result in a substantial financial penalty.

Step forward in regenerating and repairing damaged nerve cells

ScienceDaily (Nov. 21, 2012) ? A team of IRCM researchers, led by Dr. Fr?d?ric Charron, recently uncovered a nerve cell's internal clock, used during embryonic development. The discovery was made in collaboration with Dr. Alyson Fournier's laboratory at the Montreal Neurological Institute. Published November 21 in the scientific journal Neuron, this breakthrough could lead to the development of new tools to repair and regenerate nerve cells following injuries to the central nervous system.

Researchers in Dr. Charron's laboratory study neurons, which are the nerve cells that make up the central nervous system (brain and spinal cord). They want to better understand how neurons navigate through the developing embryo to arrive at their correct destination.

"To properly form neural circuits, developing axons (long extensions of neurons that form nerves) follow external signals to reach the right targets," says Dr. Fr?d?ric Charron, Director of the Molecular Biology of Neural Development research unit at the IRCM. "We discovered that nerve cells also have an internal clock, which changes their response to external signals as they develop over time."

For this research project, IRCM scientists focused on the Sonic Hedgehog (Shh) protein, which gives cells important information for the embryo to develop properly and plays a critical role in the development of the central nervous system.

"It is known that axons follow the Shh signal during their development," explains Dr. Patricia Yam, research associate in Dr. Charron's laboratory and first author of the study. "However, axons change their behaviour once they reach this protein, and this has been a mystery for the scientific community. We found that a nerve cell's internal clock switches its response to external signals when it reaches the Shh protein, at which time it becomes repelled by the Shh signal rather than following it."

"Our findings therefore showed that more than one system is involved in directing axon pathfinding during development," adds Dr. Yam. "Not only do nerve cells respond to external signals, but they also have an internal control system. This discovery is important because it offers new possibilities for developing techniques to regenerate and repair damaged nerve cells. Along with trying to modify external factors, we can now also consider modifying elements inside a cell in order to change its behaviour."

Injuries to the central nervous system affect thousands of Canadians every year, and can lead to lifelong disabilities. Most often caused by an accident, stroke or disease, these injuries are very difficult to repair. New tools are therefore required to repair damage to the central nervous system, including techniques that could potentially regenerate nerve cells.

"The Canadian Institutes of Health Research is delighted to support research aimed at improving the lives of individuals with damage to the brain or spinal cord," says Dr. Anthony Phillips, Scientific Director of CIHR's Institute of Neurosciences, Mental Health and Addiction. ''Nerve cell repair and regeneration remains an important health challenge, and we believe that Dr. Charron's research findings will contribute to the solution."

NEW YORK (AP) ? Stocks were mostly flat Tuesday on Wall Street. Hewlett-Packard stock suffered a big decline after its executives said that a company HP bought for $10 billion last year lied about its finances.

The Dow Jones industrial average was down 18 points to 12,778 three hours into trading. Other major indexes were close to break-even. HP, one of the 30 stocks that make up the Dow, declined $1.47, or 11 percent, to $11.83.

Hewlett-Packard CEO Meg Whitman said that there were "serious accounting improprities, disclosure failures and outright misrepresentations" at the company, Autonomy, which makes search engines. She stopped short of alleging fraud.

HP took an $8.8 billion charge in its latest quarter to bring the accounting value of Autonomy in line with its real value.

In the broader stock market, the Standard & Poor's 500 index lost a fraction of a point to 1,386. The Nasdaq composite index, heavy with technology companies, fell three points to 2,913.

Energy stocks and the price of crude oil fell after the president of Egypt predicted that Israel's weeklong offensive in the Gaza Strip would end in hours and the Israeli prime minister said Israel would be a "willing partner" to a cease-fire.

Crude oil was down $2.92, more than 3 percent, to $86.36 per barrel. It traded above $89 earlier in the day. Energy stocks in the S&P declined 0.7 percent as a group, making them the worst performers.

Homebuilder stocks were among the best. The government said that U.S. builders started construction last month on the most homes and apartments since July 2008.

PulteGroup rose 4.3 percent, Lennar 3.7 percent and D.R. Horton 2.5 percent.

On Monday, the Dow soared 207 points. Investors focused on signs over the weekend that congressional Republicans and the White House might be able to reach a deal on tax increases and government spending cuts set to take effect Jan. 1.

In the bond market, the yield on the benchmark 10-year U.S. Treasury note rose 0.01 percentage point to 1.63 percent.

Among stocks making headlines:

? Hormel Foods dropped $1.40, or 4.5 percent, to $29.90 after its earnings and revenue fell below Wall Street expectations. The company said sales of Spam remained strong, and it increased its annual dividend 13 percent, to 68 cents per share.

? Best Buy fell $1.62, or 12 percent, to $12.13, its lowest in more than a decade. The company, which has struggled for years against increased competition from online electronics retailers, turned in another dismal earnings report.

? Krispy Kreme Doughnuts climbed $1.64, or 22 percent, to $9.18 after it forecast earnings for 2013 above what Wall Street was expecting.

? Green Mountain Coffee rose $1.68, or 6.1 percent, to $29.01 after picking a new CEO, Brian Kelley of Coca-Cola.

? Groupon gained 31 cents, or 10 percent, to $3.42 after a hedge fund, Tiger Global, said it had bought a 10 percent stake in the company.

Drink Driving ? What is the Limit? | Criminal Defence Blawg

A fairly well know fact is that the UK?s drink drive limit is?80 mg of alcohol per 100 ml of blood (also known as BAC),?35 microgrammes of alcohol per 100 millilitres of breath or?107 microgrammes of alcohol per 100 millilitres of urine. ?But what does this mean in the real-world? 5 shots of Vodka? 1 glass of wine?

We?re All Different

Your weight, age, even the amount of stress you are under can have an affect on how your body?breaks down?the consumed alcohol and therefore makes it difficult to judge how much you can drink before going over the legal drink driving limit.

Another consideration to take into account is the type of alcohol that is being consumed. ?Drinks with ?a higher alcohol concentration level will usually be absorbed more quickly, as do carbonated drinks (such as?champagne).

One more consideration is the amount of food consumed as an empty stomach will allow the alcohol to be absorbed more quickly.

One for the Road

Once alcohol is consumed and enters your bloodstream it remains in your body can break it down. This process will usually take approximately an hour to process a unit of alcohol ? 1 unit being a single measure of spirits(40% ? 25ml) or a bottle of 3% beer.

Taking the points above into consideration, a hungry and small person may be over the drink drive limit by drinking one pint whereas another person may be able to consume more. It is therefore possible to still be over the limit the next day after a heavy night drinking, even after a long sleep.

Take it or Leave it

In short, it?s impossible to calculate exactly how much you can consume before being over the legal limit.

If you?re going out with friends and need to drive then it?s best not to drink at all. Avoiding all forms of alcohol before driving is the best way to avoid getting on the wrong side of the law. If you know you?re going to be having a drink then leave the car at home and get a taxi or a lift from a friend.

If you are pulled over and are found to be over the prescribed limit then you will be taken to a local police station to be breathalysed on the calibrated machines. If you are unable to use the machine, or the machine is unavailable, then a urine or blood sample may be taken. If these tests come back positive then you will be charged under the Section 5 Road Traffic Act 1988, at this point you should seek legal advice from an experienced drink driving solicitor.

From this point onwards the solicitor will look into the procedures taken and whether they were correctly followed as well as ensuring that the machines and samples were calibrated and not contaminated.

If the solicitor finds that procedures have been followed, and a guilty plea is unavoidable, they will be able to mitigate on your behalf at court. Allowing a solicitor to mitigate on your behalf will give you a better chance of getting a more lenient sentence, although it is possible to mitigate yourself.

US, Mexico sign rules on sharing Colorado River

Map shows the Colorado River Basin and how much water is allocated for each of the 7 states and Mexico who share from the river.

(AP) ? The United States and Mexico agreed Tuesday to new rules on sharing water from the Colorado River, capping a five-year effort on how to spread the pain of drought and reap the benefits of wet years.

The far-reaching agreement gives Mexico badly needed water storage capacity in Lake Mead, which stretches across Nevada and Arizona.

Mexico will forfeit some of its share of the river during shortages, bringing itself in line with western U.S. states that already have agreed how much they will surrender when waters recede. Mexico also will capture some surpluses when waters rise.

Also under the plan, water agencies in California, Arizona and Nevada will buy water from Mexico, which will use some of the money to upgrade its canals and other infrastructure.

The agreement, coming in the final days of the administration of Mexican President Felipe Calderon, is a major amendment to a 1944 treaty considered sacred by many south of the border. The treaty grants Mexico 1.5 million acre-feet of river water each year ? enough to supply about 3 million homes ? making it the lifeblood of Tijuana and other cities in northwest Mexico.

The pact represents a major departure from years of hard feelings in Mexico about how the U.S. manages the 1,450-mile river, which runs from the Rocky Mountains to Mexico. In 2001, U.S. states established rules on how to divide surpluses but set aside nothing for Mexico. Several years later, the U.S. government lined a border canal in California with concrete to prevent water from seeping through the dirt into Mexican farms.

"We have chosen collaboration over conflict, we have chosen cooperation and consensus over discord," said U.S. Interior Secretary Ken Salazar, who called the new pact the most important international accord on the Colorado River since the 1944 treaty.

Mexico will begin to surrender some of its Colorado River allotment when the elevation in Lake Mead drops to 1,075 feet and begin to reap surpluses when it rises to 1,145 feet. Mexico will be allowed to store up to 250,000 acre-feet of water in the reservoir and draw on nearly all of those reserves whenever needed.

The agreement expires in five years and is being billed as a trial run, potentially making it more palatable in Mexico.

"These are big political steps for Mexico to take," said Jeffrey Kightlinger, general manager of the Metropolitan Water District of Southern California, which will buy some of Mexico's water. "Chances are we won't have a surplus and we won't have a shortage but, if we do, we'll have the guidelines in place on how we're going to handle it."

In 2007, facing an eight-year drought, California, Arizona and Nevada agreed on how much each state should sacrifice during shortages on the river. That same year, the U.S. and Mexico promised to work on ways to jointly address shortages.

The negotiations gained a sense of urgency for Mexico in 2010 after a magnitude-7.2 earthquake damaged canals and other infrastructure, forcing it to store water temporarily in Lake Mead.

"No matter how sacred the treaty is, and it is, the evidence is overwhelming that you have to adjust it," said Carlos de la Parra, who advised the Mexican government on the agreement.

Los Angeles-based Metropolitan and two other agencies ? the Southern Nevada Water Authority and the Central Arizona Water Conservation District ? will buy water from Mexico as part of $21 million in payments from the U.S. to Mexico that also call for wetland preservation and other environmental measures south of the border.

California's largely agricultural Imperial Irrigation District, the largest single recipient of Colorado River water, refused to sign the agreement because it felt it should have been allowed to buy some of the water from Mexico. U.S. officials said they hoped to address those concerns.

"This is such a historic arrangement that I think, at the end of the day, it's going to be difficult for Imperial not to sign on," Salazar said.

The river is also a major source of water for Colorado, New Mexico, Utah and Wyoming.

Medieval books hold surprising fossil record

A smattering of white spots found among the ink in medieval books aren't just printing errors ? they're actually an amazingly detailed "fossil" record of European beetles, new research finds.

The dots represent spots, or wormholes, where hatching beetles chewed their way out of the woodblocks used to print art and illustrations between the 1400s and 1800s.

This literary record reveals that two species that now overlap in Western Europe once kept their distance from each other along the entire continent. Without evidence of the wormholes, this history would have been impossible to discern, said study researcher Blair Hedges, a biologist at Pennsylvania State University.

  1. Science news from NBCNews.com

    1. Climate issue heats up after superstorm

Science editor Alan Boyle's blog: The climate change issue has been virtually a non-issue during the presidential campaign ? but it's primed to take a higher profile after the elections, in part due to Hurricane Sandy's horrific aftermath.

    2. How to cope with lab-animal tragedy
    3. Elephant can speak Korean ? out loud
    4. Bulgaria claims to find Europe's oldest town

"All of these findings about the distribution were from the wormholes," Hedges told LiveScience. "There were no specimens in jars or, in this case, pinned or anything. There was just no information that we had."

Biological bookworms
European printers started using woodcuts, or carved wood blocks, to produce printed illustrations in the 1400s. (By then, that craft was already centuries-old in Japan and other parts of Asia.) Hardwood with a fine grain was typically used for the carved blocks, which would then be inked like rubber stamps to produce an image on paper or fabric.

Unfortunately for bookmakers but luckily for modern biologists, hardwoods such as box, pear or apple are a favorite of certain species of beetle, which leaves its larvae in the wood to pupate. Once the larvae grow into beetles, they gnaw their way out, leaving distinctive round holes that vary in size depending on the species. [ See images of the damaged woodcuts ]

Such was the fate of many a woodcut left in storage. Between the first edition and later printings, more and more round white dots would appear in books, Hedges said, corresponding with the beetle infestation of the woodcut. These proliferating marks provide a sort of non-stone fossil record of where beetles lived at any given time.

"It's very hard to get that kind of detailed information," Hedges said. "These are about the best fossils you could ever hope to find, and that is fossils with exact dates, like 1498, in exact locations, like Paris or Amsterdam."

Fossil record, in print
By surveying medieval tomes in library collections and in online high-resolution digital archives, Hedges was able to measure the white spots. In 473 prints dating from 1462 to 1899, he found thousands of spots, including 3,263 perfectly round holes created when beetles exited the wood block and 318 meandering "tracks" created as beetles chewed their way along the wood grain. This kind of left-behind evidence of living organisms is called trace fossils.

In books printed in northern cities such as London, the holes tended to be small, averaging about 0.06 inches across. In southern European cities, they were larger, averaging about 0.09 inches across. Distinctive tracks also gave away southern species.

These measurements reveal that in the north, the woodcut-chewer was the common furniture beetle (Anobium punctatum). In the south, the Mediterranean furniture beetle (Oligomerus ptilinoides) was the culprit. Surprisingly, the two never met. They stayed on either side of a line that cut across France, hugged the border between Switzerland and Germany and then followed the boundary between Italy and Austria.

"There was no gap in between," Hedges said. "They literally came right up to each other, certainly within miles. I could not find any evidence that they overlapped."

That sort of boundary is very unusual in species distribution, he said. Because climate varied over those 500 years, the stable border between northern and southern species probably had to do with the fact that both beetles prefer the same kind of wood.

"They were trying to avoid competition, so they weren't overlapping," Hedges said.

Today, with increased trade in furniture and lumber, both beetles are found throughout Western Europe. In Eastern Europe, the situation looks a little more complex, Hedges added. And he hasn't even had time to get into American woodcuts or other regions of the world.

"Japan and China did woodcut printing even earlier than Europe," he said. "There's a lot of potential for discovering other species and other interactions."

Hedges published the findings Nov. 20 in the journal Biology Letters.

Decreased Sexual Interest Most Common Complaint Among Women With Breast Cancer

FIRST PERSON | Research presented at the Oncology Nursing Society (ONS) Connections: Advancing Care Through Science conference discloses that decreased sexual interest is the most common complaint among women with breast cancer. 13.8 million women are breast cancer survivors in the United States. The research reported on results from 896 women.

The Oncology Nurse Advisor reports the research presented at the conference included information taken from the American Cancer Society Study of Cancer Survivors II. The study showed that among the 896 women included in the ONS research, 21.1 percent of them reported a decrease in sexual interest. This does not surprise me. As a one-year cancer survivor and someone still undergoing treatment, I can relate to the study.

Breast cancer is not sexy

Despite the media and marketing industry's attempt to objectify breast cancer as something sexy, with stupid terms like "save second base" or "I love boobies," those of us who are fighting cancer don't see it as sexy.

I lost my left breast to breast cancer. Chemo put me into early menopause and made my hair fall out. My body image has changed forever -- I will never look the same as I did before cancer. Scars tell the tale of my battle and most days I still feel like crap. Do I think about sex? Yes, but I miss the way it used to be. What I am dealing with now is something drug-induced and artificial.

Doctors don't tell

My oncologist did not discuss all of the issues I would face with chemotherapy-induced menopause. I expected hot flashes and the end of my cycle. That was just the tip of the iceberg. There are many more symptoms that coincide with chemo-induced menopause -- too many to discuss in this article and many are too personal for me to talk about in print.

Dealing with a radically different body image, scarring, feeling awful -- both emotionally and physically -- takes its toll on sex drive. Women like me do think about sex. We want to get back what chemo and surgery has taken away. I do believe that the research is correct on this. What surprises me is that only 21.1 percent of the women in the study said that they had a decrease in sexual interest. I thought the number would be much higher.

Lynda Altman was diagnosed with breast cancer in November 2011. She writes a series for Yahoo! Shine called "My Battle With Breast Cancer."

5 Do-Now Home Office Tips that Will Pay Off Big in 2013 | ShoreTel ...

By: ShoreTel, Brilliantly Simple

Is your home office everything it should be? Can you be productive there? Are your communications with your co-workers, manager and customers as effective from home as they are at work?

Even if you answered ?no? to these questions, it?s easy to right your home office and turn it into a haven that helps you be a more effective, creative, focused professional.

Working from home is on the uptick. In only 10 years?from 1999 to 2010, the number of people who worked at home at least one day per week increased from 9.5 million to 13.4 million, according to the Survey of Income and Program Participation. A report in InformationWeek indicated 90% of key staff members work offsite at least occasionally, while 30% spend half their working time offsite.

The number of home workers, or teleworkers, is expected to continue to increase in the coming years as companies adopt the mobile lifestyle. Based on the previously cited survey, Monday and Fridays are the most popular days to work at home, and metro areas in the Southeast, Southwest and West have the largest percentage of teleworkers. ? ?

Whether you are in your home or at your office desk, a big portion of your day is spent in meetings and phone conferences. Teleworkers have relied on calling in to these gatherings for years, but video conferencing is becoming a much better option. According to studies by verbal communication researcher Albert Mehradian of UCLA, 55% of human communication is non-verbal, making voice-only conversations a poor substitute for the real thing. Video conferencing can add that personal touch and the non-verbal clues that enrich communications. And while many of the 35-and-over crowd was initially uncomfortable being ?on camera,? they are overcoming their fears as Skype and Facetime become a regular part of our daily lives.

The Home Office Hero?

Now is the time to set up your home office with an industry-leading video conferencing solution that can provide a competitive edge for you and your company in all your communications. These five tips will help you present yourself and your company at your best.

Create an inviting, experienced office ambience.
You want to consider your office?s lighting, appearance and background. Poor lighting can be extremely distracting to those watching you. If possible, use a lot of natural bright lighting, but not directly behind you. When you are lit directly from behind your face will be unrecognizable. Your office should also be neat and free from clutter. And finally, consider what viewers will see?in addition to you. A background of bookshelves is one good option. Try to avoid a closet door or completely blank wall.

Ensure clear communication with industry-leading video equipment.
Skype and Facetime are simple and easy to use, but they aren?t ready for business yet. You will want a scalable, high-performance platform that won?t hang during your conference or provide jerky, pixelated images. You?ll also want an external web cam. Integrated cams provide a very stilted, static view. An external web cam provides the flexibility to stream video from anywhere and at different angles.

Collaborate with one or many using robust video conferencing features.
Attending and leading video conferences are extremely important for large-scale projects. You will want an easy way to invite participants and the ability to provide toll-free numbers so they can easily attend. These meetings often hinge on the ability to share materials such as presentations, spreadsheets, documents and images. At the end of the meeting, you?ll also want to share a recording, in case attendees need to review certain points.

Display a professional, savvy responsible appearance.
How you look on screen is important. You may want to consider a green screen background that will allow you to imprint certain images or your company logo behind you. You will want to be careful that the clothing you choose doesn?t blend into your background. If you?re video conferencing with customers are partners, wear a shirt with a logo that quickly reminds your viewers who you are representing.

Contribute to your company?s bottom line.
Video conferencing from home isn?t only a convenience for you; it can also save your company money in reduced travel costs. And it?s impossible to dismiss how a professional on-camera presence portrays your company as a technology leader. People will be able to associate your good ideas with a face, a personality and a voice. Video conferencing provides that personal touch that a phone conference alone has always lacked.

Knuckles and nails get invite to the touchscreen party

FOR all the swiping, flicking, pinching and zooming, our interactions with touchscreens are still pretty limited. That could be about to change.

To open up the screens to commands from other parts of the hand, Chris Harrison, a computer scientist at Carnegie Mellon University in Pittsburg, Pennsylvania, has built a prototype smartphone that can distinguish between touches from the knuckle, fingertip and even fingernail. He has just launched a company called Qeexo to sell his device.

A modified Samsung Galaxy S3 smartphone, fitted with a small vibration sensor and running Harrison's FingerSense software, listens for the acoustic and vibrational differences between the three different types of touch. A fingertip could select an object while a knuckle tap could work like the right-click on a computer mouse and open up a submenu, for example.

"A big problem with touchscreens right now is that they are very simplistic, relative to the capability of our hands," Harrison says. "We could do so much more."

"The more ways you have of expressing input into smartphones the better," says Joseph Paradiso at the MIT Media Lab in Boston, who has worked on similar technology.

Harrison says the sensor is a standard piece of electronics that can be added to the main circuit board of any smartphone, and he is already in talks with major phone manufacturers to do just that. "The real magic is in the software, this artificial intelligence that lives in the heart of the phone," he says.

Amex Small Business Saturday Registration is Open! - Mommy Points

Just a quick note to say that Amex Small Business Saturday registration is now open and fully operational.? I was able to register all of my Amex issued cards, authorized user cards that have unique card numbers, and my Citibank issued Amex card without any issue.? I should then be able to use them at a small business on Saturday November 24th and get a $25 statement credit from Amex on each card when I charge at least $25 on each card.

When you register, it says that additional cards linked to the same account must be registered separately, so seems to me that they are overtly supporting authorized user cards being registered.? Prepaids, Bluebirds, and corporate cards are not able to be registered.? When I tried my Bluebird it said ?this card is not eligible for this offer?.

To get full details about this promotion and how I plan to maximize it, head to this post.? Registration is limited, so get your Amex cards registered today!? Were you able to get your cards registered?? Where do you plan to shop?

ASU Coach Wary Of 'Improving' Cougars

The Cougars play their final road game of the season Saturday in Sun Devil Stadium against Arizona State. The Cougars have yet to win a Pac-12 game. / Wiki Commons

GAME:Washington State (2-8 overall, 0-7 Pac-12)at Arizona State (5-5 overall, 3-4 Pac-12). WHEN: Saturday, noon PT, Sun Devil Stadium, Tempe, AZ. MEETING: 39th (Arizona State leads 23-13-2). COACHES: Mike Leach, WSU; Todd Graham, Arizona State. RANKINGS: Neither ranked. LINE: ASU by 14?. TV: Pac-12 Networks. RADIO: ESPN 710 and IMG College Sports Network.

Two investigations, one by Washington State, the other by the Pac-12 Conference, will shortly verify or reject ex-Cougas wide receiver Marquess Wilson's allegations of physical and mental abuse of players by Mike Leach's coaching staff. More imminently, the Cougars are 2-8 and looking at their fourth season of double-digit defeats since 2008.

But while many might see turmoil in the Palouse, Arizona State Coach Todd Graham sees something else -- a vastly improved WSU team, regardless of its miserable record.

"You can tell the difference between where their system was four weeks ago to where it is now," said Graham, whose Sun Devils host the Cougs Saturday afternoon in Sun Devil Stadium. "They came back (despite four blocked kicks) and gave UCLA a run for their money. You look at the Stanford game (24-17 WSU loss) and they're sitting there in the red zone getting ready to score and tie the game up.

"They're making great strides there, and it's a very difficult offense to defend. They're a very capable football team. I see a very capable offense that's putting up 400 yards, as they did against Stanford and UCLA, two really good defenses. They play hard, these guys. Obviously defensively, their guys play extremely hard and extremely physical.

"We have to play well, and our guys know that. We've come up short four games in a row, and we have to go out and get the win. Our guys are going to be very motivated and focused and know that they're playing a capable team."

Arizona State spent the first month and a half of the season in the national rankings, winning five of six. The Sun Devils have since lost four consecutive games to fall to .500 (5-5). They need one win in their final two to become bowl eligible.

"Arizona State is a lot like us," said Leach. "They play in spurts. The difference (in the first six games vs. the last four) is that their level of competition has changed (ASU's four losses were to Oregon, UCLA, Oregon State and USC, all nationally ranked). Plus, they are probably getting thin, as teams do this time year. But they are still a really good team with a really good defense and some explosive skill guys."

Leach has yet to name his starting quarterback. UCLA knocked senior Jeff Tuel out of last Saturday's game with what appeared to be a shoulder injury. But Tuel practiced this week and said he is fit to play. Conner Halliday, who replaced Tuel, threw five touchdown passes against the Bruins, trying a school record as the Cougars rallied from a 30-point deficit.

Halliday also had a monster game last year against Arizona State, throwing for 494 yards and four touchdowns.

For a program supposedly in turmoil, the Cougars certainly got UCLA coach Jim Mora's attention last week. Asked how his club could blow a 30-point lead and lose the second half 27-7 to a 2-7 team, Mora said, "We did not lose intensity. Washington State fought their butts off the whole game."

"Guys are buying into this program," said Tuel. "We just need to bring it all four quarters and be nasty dudes who never give up. We know we can play with the best. We just have to find a way to mass produce it."

SERIES:?Dates to Oct. 1, 1960, when Arizona State recorded a 24-21 win in Tempe, AZ. ASU has won seven of the last eight meetings, but WSU won the last one, 37-27, last season behind Connor Halliday's 494 yards and four touchdowns in Pullman. ASU won the last meeting in Tempe, 42-0, in 2010. WSU coach Mike Leach has never faced Arizona State.

WSU HEAD COACH: Mike Leach (87-49 overall, 2-8 WSU):Hired Nov. 30, 2011 to replace Paul Wulff, who went 9-40 in four seasons, Leach in 10 seasons at Texas Tech (2000-09) earned 10 bowl bids. The Susanville, CA., native, who was raised in Cody, WY., recorded a school-record 84 victories. Leach's offenses led the nation in passing six times and three times accumulated the most total yards.
